Terms of Service

These Terms of Service ("Terms") govern your use of MyDonateBox, operated by BitterSweet Software Inc. ("we", "us", "our"), a company based in Hamilton, Ontario, Canada. By creating an account or using the Service, you agree to these Terms.

The Service

MyDonateBox provides embeddable donation widgets that allow organizations to accept donations on their websites. We facilitate the connection between your organization and Stripe for payment processing. We are not a payment processor; Stripe handles all financial transactions.

Eligibility

You must be at least 18 years old to create an account. By using the Service, you represent that you have the legal authority to bind the organization you register on behalf of. You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction.

Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree not to use the Service to:

• Collect donations fraudulently or for purposes that misrepresent your organization
• Violate any applicable law, regulation, or third-party rights
• Process payments for illegal goods, services, or activities
• Distribute malware, spam, or any harmful code through the widget
• Interfere with or disrupt the Service or its infrastructure
• Circumvent any limitations or restrictions of the Service
• Resell or redistribute the Service without our written permission

We reserve the right to suspend or terminate your account if we reasonably believe you are violating these Terms.

Fees and Payment

MyDonateBox charges a platform fee on each donation processed through the Service. The current fee is displayed on our pricing page. Stripe's standard processing fees apply separately and are charged by Stripe directly.

We reserve the right to change our fees with 30 days' notice. Fee changes will not apply retroactively to donations already processed.

Stripe Connect

To accept donations, you must connect a Stripe account to the Service. Your use of Stripe is governed by Stripe's own terms of service and privacy policy. We are not responsible for Stripe's services, availability, or any actions taken by Stripe regarding your account.

Donations are processed on your connected Stripe account. Funds are deposited directly into your bank account by Stripe, minus applicable fees. We do not hold, manage, or have access to your donation funds at any time.

Widget Embedding

You may embed the donation widget on websites you own or are authorized to manage. The widget loads from our CDN and communicates with our API. You are responsible for ensuring the widget is used appropriately on your site.

We may include a "powered by MyDonateBox" attribution in the widget. You may not remove or obscure this attribution unless you are on a plan that permits its removal.

Intellectual Property

The Service, including its code, design, branding, and documentation, is owned by BitterSweet Software Inc. and protected by applicable intellectual property laws. You retain ownership of the content you create within the Service (organization names, widget titles, descriptions).

We grant you a limited, non-exclusive, revocable license to use the Service and embed the widget in accordance with these Terms.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for any loss of data, revenue, or donations resulting from Service downtime or errors.

Limitation of Liability

To the maximum extent permitted by law, BitterSweet Software Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in fees during the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless BitterSweet Software Inc., its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Termination

You may close your account at any time by contacting us. We may suspend or terminate your account at any time for any reason, including violation of these Terms, with or without notice.

Upon termination, your widgets will stop functioning and your data will be deleted in accordance with our Privacy Policy. Any fees owed at the time of termination remain payable.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Hamilton, Ontario.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or sending you an email at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms take effect constitutes your acceptance.
